Draft proposals for EU patent
Despite the recent setback regarding the creation of a centralised European Patents Court (reported here), the European Commission has been moving forward with plans for the unitary EU patent. Earlier this month a draft proposal for an EU Regulation creating a system of unitary patent protection was announced, along with an accompanying draft Regulation on the relevant translation arrangements. The Commission has yet to suggest an alternative to the rejected centralised Patents Court, however, so it remains to be seen how the proposed unitary patent will be enforced.

One step forward, two steps back - future of EU patent remains uncertain
The EU Council has now authorised the use of the 'enhanced cooperation' procedure for the creation of a unitary European patent (see earlier article here). However, in a possible setback to the progress of the unitary EU patent, the Court of Justice of the European Union (CJEU) recently rejected the proposed formation of a single European and EU Patents Court as incompatible with the provisions of the EU treaty.
